These Terms of Service ("Terms") govern your access to and use of the website detectivedental.com (the "Site") and the toll-free dental referral service operated by HyperTarget Marketing, LLC (the "Service"). By using the Site or calling our referral line, you agree to these Terms. If you do not agree, please do not use the Service.
Plain-English summary: We connect you with independent dental practices. We are not a dentist. We don't provide medical advice. The dental practice you choose is responsible for the care it provides. If you have a medical emergency, call 911. There's an arbitration agreement and class-action waiver in Section 10 — please read it.
1. The Service
Detective Dental is a free consumer telephone referral service that helps connect callers with independent dental offices, call centers, and marketing partners. We are not a dental office, dentist, dental insurer, healthcare provider, or emergency medical service. We do not employ dentists. We do not provide dental advice, diagnosis, or treatment. The dental office you choose to engage is independent and is solely responsible for the dental care, advice, treatment, scheduling, pricing, and insurance acceptance it provides. Availability, pricing, services, insurance acceptance, and appointment times vary by provider.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent that you are at least 18 years old, that you have legal capacity to enter into these Terms, and that your use of the Service is permitted under the laws of your jurisdiction.
3. No medical advice; no emergency line
Information on the Site or provided by our agents is for general informational purposes only and is not a substitute for professional dental or medical advice, diagnosis, or treatment. Do not rely on information from the Site or our agents for medical decisions. Always seek the advice of a qualified dental or medical professional regarding any medical condition.
If you are experiencing a medical emergency, call 911 immediately. Our referral line is not an emergency line.
4. Free to use; how we make money
Calling our referral line and using the Site are free for callers. We are paid by participating dental offices, call centers, or marketing partners when we successfully connect them with a new caller. This fee is not paid by you and does not affect the cost of the dental services you may choose to receive from any dental office.
5. Your responsibilities when using the Service
You agree to:
- Provide accurate, current information when you call
- Use the Service only for legitimate personal purposes (not for commercial reseller activity, scraping, or automated querying)
- Not impersonate another person or use the Service in a way that interferes with its operation
- Comply with all applicable laws, including any laws governing your use of telephone services
6. Recording of phone calls
Calls to our referral line may be recorded or monitored for quality, training, and dispute resolution where permitted by law. Where required by state law, our agents will inform you that the call is being recorded at the start of the call. You may decline to be recorded; in that case we may continue without recording or politely end the call.
7. Intellectual property
The Site, including all text, graphics, logos, and software, is owned by or licensed to HyperTarget Marketing, LLC and is protected by U.S. and international copyright, trademark, and other intellectual property laws. "Detective Dental" is a service mark of HyperTarget Marketing, LLC. You may use the Site for personal, non-commercial purposes only. You may not copy, modify, distribute, sell, or create derivative works without our express written permission.
8. Third-party content and links
The Site may contain links to third-party websites and services. We do not control, endorse, or assume responsibility for any third-party sites, content, products, or services. Your use of any third-party site is at your own risk and subject to that site's own terms and privacy policies.
9. Disclaimers and limitation of liability
The Service and Site are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, error-free, or secure.
We do not warrant that any particular independent dental office in our partner network will be available at the time of your call, will accept your insurance, will offer any particular pricing, will provide care that meets your expectations, or will have any specific qualifications beyond holding a license to practice in the relevant jurisdiction. Same-day or next-day appointments are not guaranteed and depend on each dental office's availability. Your relationship with the dental office is between you and that dental office.
To the fullest extent permitted by law, HyperTarget Marketing, LLC and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total cumulative liability for any claim arising from these Terms or your use of the Service will not exceed one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above may not apply to you in full.
10. Arbitration agreement and class-action waiver
Please read this section carefully. It limits your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Service ("Dispute") will be resolved through final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court if eligible. The arbitration will take place in Travis County, Texas, unless you and we agree otherwise. The arbitrator's decision will be binding and may be entered as a judgment in any court of competent jurisdiction.
You and we agree that each may bring claims against the other only in your or our individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
You may opt out of this arbitration agreement by sending written notice within 30 days of first using the Service to: HyperTarget Marketing, LLC, Attn: Legal — Arbitration Opt-Out, Austin, TX. The notice must include your full name and a clear statement that you wish to opt out of arbitration.
11. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Subject to Section 10, you and we agree that any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. If we make material changes, we will provide reasonable notice (for example, by posting a notice on the Site). Your continued use of the Service after a change takes effect means you accept the updated Terms.
13. Termination
We may suspend or terminate your access to the Service at any time, for any reason, with or without notice. Sections 7 (Intellectual property), 9 (Disclaimers / Limitation of liability), 10 (Arbitration), 11 (Governing law), and any other provisions intended to survive will survive termination.
14. Miscellaneous
These Terms, together with our Privacy Policy and California Privacy Notice, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
